Britney Spears' Judge Denies Request to Suspend Jamie Spears' Conservatorship Duties

    The most recent attempt by Britney Spears‘ team to remove her father from her conservatorship has proven unsuccessful. 

    A Los Angeles Superior Court judge denied a request from the pop star’s lawyer, Samuel D. Ingham III, to have Jamie Spears dropped as his daughter’s co-conservator, as stated in the court order obtained by E! News that the judge signed on Wednesday, June 30.

    Jamie was named co-conservator of Britney’s estate and person in 2008, with wealth-management firm Bessemer Trust Company joining him last year as co-conservator of the estate.

    “The conservator’s request to suspend James P. Spears immediately upon the appointment of Bessemer Trust Company of California, N.A. as sole conservator of estate is denied without prejudice,” the document read. 

    This decision follows Britney’s impassioned public testimony at the court hearing about her conservatorship on Wednesday, June 23. During her remarks, the 39-year-old “If U Seek Amy” singer was highly critical of her father and alleged that he “loved the control to hurt his own daughter.”

    At the time, Jamie’s attorney issued a statement that read, “Mr. Spears is sorry to see his daughter suffering and in so much pain. Mr. Spears loves his daughter and misses her very much.”

    Back on Nov. 10, 2020, the court declined a previous request from Britney’s legal team to suspend Jamie, 68, as conservator of her estate. At that time, the judge also decided Jamie would be joined by Bessemer Trust Company as co-conservator. 

    On Tuesday, June 29, Jamie filed a petition that has been obtained by E! News and called for an investigation into Britney’s allegations of mistreatment against her conservatorship. In the document, Jamie noted that he has not managed his daughter’s personal or medical affairs for the past two years.

    Britney Spears‘ father Jamie Spears has filed legal documents calling for an investigation into the singer’s claims of mistreatment, which she detailed in a scathing court statement against him and the 13-year conservatorship he continues to partially control.

    In a petition filed in Los Angeles on Tuesday, June 29, and obtained by E! News, Jamie, 68, said he is “concerned about the management and care of his daughter,” noting that for the past two years, he has not managed her personal or medical affairs. He does co-manage her estate with a financial company.

    Britney’s father was responsible for her personal and financial dealings for more than a decade after he was first made her conservator in 2008, following her psychiatric hospitalization. In her court testimony last week, the pop star called her conservatorship “abusive” and requested that it end without her being evaluated by a therapist.

    “Mr. Spears requests instructions and an order from the Court to investigate the veracity of the allegations and claims made by Ms. Spears at the June 23, 2021 status hearing,” Jamie’s filing states. “Given the nature of the allegations and claims, it is critical that the Court confirm whether or not Ms. Spears’s testimony was accurate in order to determine what corrective actions, if any, need to be taken. It is also imperative for the proper functioning of conservatorship proceedings before this Court that all parties be provided a full and fair opportunity to respond to allegations and claims asserted against them, including by way of an evidentiary hearing.”

    However, in her testimony, Britney, 39, put a good amount of blame on her father, speaking in detail about life under what she described as his “control.” She said, “My precious body has worked for my dad for the past f–king 13 years, trying to be so good and pretty.” She also alleged receiving unwanted medical and psychiatric care while under conservatorship.

    Following her remarks, her first public comments about it, Jamie’s lawyer said in a statement to the court that the star’s father “is sorry to see his daughter suffering and in so much pain. Mr. Spears loves his daughter and misses her very much.” 

    The attorney has previously said Jamie believes ever decision he’s made has been in Britney’s “best interest.”

    In 2019, Jodi Montgomery was made the singer’s temporary conservator of her person, or manager of her personal and medical affairs, after Jamie stepped aside from such duties due to his own health issues. This past March, Britney’s court-appointed attorney, Sam Inghamfiled papers requesting that Jodi replace Jamie in the role permanently.

    Jodi’s lawyer said in a statement to E! News on Wednesday, June 30, “I can state unequivocally that Jodi Montgomery has been a tireless advocate for Britney and for her well-being. While she does not control Britney’s financial assets, she is responsible for her personal care, and if Britney wants any issue brought up to the Court, Ms. Montgomery is and has always been ready, willing, and able to do so. From the very beginning of her appointment in September 2019, Ms. Montgomery and the medical team that she assembled have had one primary goal—to assist and encourage Britney in her path to no longer needing a conservatorship of the person.”

    In her court testimony, Britney testified about her physical and mental health treatment, alleging that she was put on psychiatric medication that she “never wanted to be on to begin with.” The singer, a mother of two sons and who is dating Sam Asghari, also told the court she wants to marry again and have a baby but is unable to because she claims “so-called team won’t let me go to the doctor” to take out a birth control IUD that was put inside her body.

    In his statement, Jamie reiterated he is not involved in decisions regarding his daughter’s personal or medical affairs, adding, “Unlike Ms. Montgomery and Mr. Ingham, Mr. Spears does not speak or meet with Ms. Spears’ medical team, and he is not permitted to nor does he have the opportunity to provide any input into his daughter’s current medical treatment, diagnosis, or therapy. Nor does Mr. Spears participate in or discuss Ms. Spears’ personal affairs with her, such as issues related to her self-care, marriage, and reproductive desires. These are issues under the purview of Ms. Montgomery as Ms. Spears’ conservator of the person, and issues that Ms. Spears presumably discusses with her court-appointed attorney, Mr. Ingham.”

    Jodi’s lawyer said in their statement, “As to Britney’s right to marry, that is unaffected by the conservatorship under Probate Code §1900. As to family planning, that is also unaffected by the conservatorship. If Britney needs any assistance with either, Ms. Montgomery has and will be there to provide any assistance needed to Britney. Britney’s choice to marry and to start a family have never been impacted by the conservatorship while Ms. Montgomery has been conservator of the person.”

    Jamie noted in his filing that in past years when he was in charge of his daughter’s personal affairs, he “never prevented” her from getting married. While she did not end up walking down the aisle again, Britney was engaged to her former agent Jason Trawick for just over a year until they split in 2013. During their relationship, he briefly served as her co-conservator.

    In his March 2021 filing requesting that Jodi be made Britney’s conservator of her personal and medical affairs, Britney’s lawyer cited a 2014 order that determined the pop star had an “incapacity to consent to any form of medical treatment,” CNN reported. In his recent filing, Jamie claimed the attorney “incorrectly” stated that Britney’s alleged incapacity to consent to treatment “was determined by order filed in this matter.” The singer’s father’s petition read, “But there was no such finding and there is no such order.”

    Jamie also said in his petition that based on his daughter’s recent court testimony, “it is unclear if she is even aware of and agrees with” the statements made in her lawyer’s request to appoint Jodi, “including specifically that she lacks capacity of give informed consent for her own medical treatment.” Jamie added, “This is something that should also be further investigated by the Court.”

    Jodi’s attorney said in Wednesday’s statement, “Since being appointed in September 2019, Ms. Montgomery has tirelessly acted in Britney’s best interests with the approval of her doctors and the oversight of the Court.”

    The co-conservator’s lawyer also said, “While it is Ms. Montgomery’s professional duty to be Britney’s protector and advocate, honoring her wishes and seeing to her best interests while Britney is under conservatorship, it is her sincere personal wish that Britney continues to make meaningful progress in her well-being so that her conservatorship of the person can be terminated. Ms. Montgomery looks forward to presenting a comprehensive Care Plan to the Court setting forth a path for termination of the conservatorship for Britney, and Ms. Montgomery looks forward to supporting Britney through that process.”

    In a series of videos posted through Instagram Stories on June 28, the 30-year-old actress addressed her sister’s shocking testimony and plea to end her conservatorship after more than a decade.

    “I just want to take a second to address a few things,” Jamie Lynn began. “The only reason I haven’t before is because I felt like until my sister is able to speak for herself and say what she felt she needed to say publicly, that it wasn’t my place or it wasn’t the right thing to do. Now that she has very clearly spoken and said what she needed, I feel like I can follow her lead and say what I feel I need to say.”

    The Zoey 101 star continued by saying she has “loved, adored and supported” Britney since the day she was born. And although she may not have been outspoken in the past, Jamie Lynn assured fans she was supportive of her older sister behind closed doors. 

    “I don’t care if she wants to run off to the rainforest and have a gazillion babies in the middle of nowhere or if she wants to come back and dominate the world the way she has so many times before,” she explained. “I have nothing to gain or lose either way. This situation does not affect me either way because I am only her sister who is only concerned about her happiness.”

    “I have made a very conscious choice to only participate in her life as her sister, as an aunt to those boys. Maybe I didn’t support the way the public may have liked me to with a hashtag on a public platform, but I can assure you I have supported my sister long before there was a hashtag and I’ll support her long after…note that.”

    Britney is the proud mom to Sean Preston, 15, and Jayden James, 14, with ex Kevin Federline.

    Back on June 23, Britney spoke to a Los Angeles judge and requested that her conservatorship be terminated. In her statement, the Grammy winner alleged that she had been subjected to numerous psych evaluations, medications and that she was traumatized by her father, Jamie Spears, through his control. Jamie has served as a co-conservator of Britney’s estate since 2008.

    After Britney spoke, an attorney shared a statement on behalf of Jamie. “Mr. Spears is sorry to see his daughter suffering and in so much pain,” the statement read. “Mr. Spears loves his daughter and misses her very much.”

    And in March, Jamie’s attorney told CNN, “Jamie is not suggesting that he is the perfect dad or that he would receive any ‘Father of the Year’ award. Like any parent, he doesn’t always see eye-to-eye on what Britney may want. But Jamie believes every single decision he has made has been in her best interest.”

    In her latest social media posts, Jamie Lynn tried to distance herself from her extended family proclaiming she was “my own person” who was “speaking for myself.”

    “I am so proud of her for requesting new counsel like I told her to do many years ago. Oh, not on big public platform but just in a personal conversation between two sisters,” she shared. “So, I am very proud she has taken that step. If ending the conservatorship or whatever hell else she wants to do to be happy, I support that 100 percent because I support my sister. I love my sister, always have and always will as long as she’s happy. So, let’s keep praying. That’s all.”

    After the hearing, a judge praised Britney for her courage in speaking out, but said the music superstar needs to submit a petition to the court requesting the termination of the conservatorship before any next steps could be taken. No new dates were set.

    “I can assure you her family loves her and wants the best for her,” Jamie Lynn’s husband told The New York Post on Friday, June 25. “I wouldn’t be around people who weren’t. Who wouldn’t want to be in support of Britney?”

    At the hearing, the singer accused her dad of being controlling, called the conservatorship “abusive” and “stupid” and requested that it end without her being evaluated by a therapist.

    Britney’s father responded to the singer’s comments at Wednesday’s court hearing through a statement read by his attorney, which said, “Mr. Spears is sorry to see his daughter suffering and in so much pain. Mr. Spears loves his daughter and misses her very much.”

    While Britney’s brother-in-law has commented on her statement, Jamie Lynn herself has not. However, last year, the Zoey 101 alum responded to a user who wanted her to comment about her sister’s mental health, “You have no right to assume anything about my sister, and I have NO right to speak about HER health and personal matters. She is a strong, badass, unstoppable woman, and that’s the only thing that is OBVIOUS.”

    At Wednesday’s court hearing, Britney said she wanted to be able to meet with a therapist once a week at most, and at her own home to maintain privacy. The singer has in the past undergone mental health treatment both at her house and at clinics. At the hearing, Britney also described what she said was a phone call with her father about a past treatment plan for her.

    “‘I’m sorry, Brittany, you have to listen to your doctors. They are planning to send you to a small home in Beverly Hills to do a small rehab program that we’re going to make up for you. You’re going to pay $60,000 a month for this.’ I cried on the phone for an hour and he loved every minute of it,” she said. “The control he had over someone as powerful as me as he loved to control to hurt his own daughter and 100,000%. He loved it.”

    She also said in her statement, “My precious body has worked for my dad for the past f–king 13 years, trying to be so good and pretty. So perfect because he works me so hard when I do everything I’m told.”

    Britney also spoke during her testimony about the alleged restrictions on her personal life under conservatorship and made another accusation: She claimed she was prohibited from removing an intrauterine device for birth control that was placed in her body.

    “I want to be able to get married and have a baby,” said the singer, a mother of two sons from a previous marriage and who is currently dating Sam Asghari. “I was told right now on the conservatorship. I’m not able to get married or have a baby. I have a [IUD] inside of myself right now so I don’t get pregnant. I wanted to take the [IUD] out so I could start trying to have another baby. But this so-called team won’t let me go to the doctor to take it out because they don’t want me to have any children, any more children.”

    Britney added, “Basically, this conservatorship is doing me way more harm than good. I deserve to have a life.”

    Meanwhile, an attorney for Britney and Jamie Lynn’s mom, Lynne Spears, said the 66-year-old matriarch, who is not a conservator, is a “very concerned mother” after hearing the singer speak to the court. The attorney, who was present during the hearing, also encouraged the judge to listen to Britney’s request to hire her own private lawyer and to change her care plan.

    “I first want to say that was very courageous of Ms. Spears,” Lynne’s attorney said during the court proceedings. “One thing I want to raise with the court… is when she was there in May 2019 that she didn’t feel like she was heard. I feel we need to make sure today that she was heard.”

  • It’s time for some well-deserved R&R. The day after sharing her truth in court, Britney Spears set off for a Hawaiian vacation to unwind with her boyfriend.

    The “Lucky” singer and trainer Sam Asghari flew on a private jet to Maui in the morning on Thursday, June 24, an eyewitness exclusively tells E! News.

    “Britney looked very happy and excited to be going back to Hawaii,” reveals the witness. “She was giddy and all smiles as she landed on the island.”

    The couple headed to her favorite resort on the island for check-in, and then they went straight to the pool. Per the witness, they had fresh fruit juice in their hands and “looked relaxed and happy.” 

    Britney, 39, and Sam, 27, sat side-by-side on chaise lounges at the pool, while they talked and laughed at their conversation. At one point, Britney closed her eyes to take a nap.

    The source continues, “They thought about heading down to the beach, but it looked very crowded so they stayed at the pool. Britney looked like she was in her happy place in a pink bikini at the pool getting some sun.”

    They stayed for about an hour before going back to their room for the rest of the day, the insider adds. 

    Just one day before, Britney appeared at a virtual court hearing, where E! News was present, as she told all about her “abusive” conservatorship. “I haven’t done anything in the world to deserve this treatment,” she testified. “It’s not OK to force me to do anything I don’t want to do.”

    She also said she wants to get married and have a baby, presumably with Sam, but is prohibited from removing her birth control. “I haven’t done anything in the world to deserve this treatment,” she told the judge. “It’s not OK to force me to do anything I don’t want to do.” 

    In response, a lawyer for her father, Jamie Spears, who is co-conservator of her estate, read the statement: “Mr. Spears is sorry to see his daughter suffering and in so much pain. Mr. Spears loves his daughter and misses her very much.” 

    On the day Britney set off for Hawaii, she penned a letter on social media, apologizing for “pretending” to be fine all these years. 

    As the pop star wrote, “I don’t want people to think my life is perfect because IT’S DEFINITELY NOT AT ALL … and if you have read anything about me in the news this week … you obviously really know now it’s not !!!!” She went on, “I apologize for pretending like I’ve been ok the past two years… I did it because of my pride and I was embarrassed to share what happened to me … but honestly who doesn’t want to capture there Instagram in a fun light.”

    For his part, Sam took to Instagram to share funny videos of the couple on their flight to the Aloha state, as they posed with dog filters. “You’re welcome,” the fitness mogul wrote

    In addition to being her travel partner, Sam has been by Britney’s side throughout her court battle. He made his stance known ahead of the hearing, when he posted a selfie in a Free Britney T-shirt. 

    A separate source close to Sam told E! News this week, “Britney feels like the weight of the last decade or so is slowly but surely lifting off of her shoulders. She feels empowered beyond words, and a large part of that is Sam, who empowers her in every way and has been her rock throughout this entire ordeal since she decided to speak up. She is eternally thankful to have him in her corner.”

    The pair first met in 2016 on the set of her “Slumber Party” music video.

    That’s what fans are asking after the music superstar appeared at a hearing on June 23 where she testified to a judge about her experience being under a conservatorship.

    According to NBC News, who had a reporter inside the courtroom, the 39-year-old mother of two asked to end her conservatorship without being evaluated and explained why she has been silent for so long. “After I’ve lied and told the whole world I’m OK and I’m happy…I’m not OK, ” she shared in a statement. “I’m not happy, I can’t sleep.” 

    While appearing on E!’s Daily Pop on June 24, attorney Tamar Arminak, who has been involved with Amanda Bynes‘ conservatorship, shared her insight into what’s next for Britney.

    “I think what she did yesterday was very brave and unexpected by everyone,” Tamar told hosts Justin Sylvester, Morgan Stewart and Heather Rae Young. “I’m not sure she’s going to get rid of the conservatorship, but she certainly made a case for getting her father off as conservator. Absolutely and I think that’s step one.”

    After the singer’s impassioned words, an attorney shared a statement on behalf of Jamie. “Mr. Spears is sorry to see his daughter suffering and in so much pain,” the statement read. “Mr. Spears loves his daughter and misses her very much.”

    Still, Tamar, who is not involved with Britney’s case, believes there needs to be “substantive change” in the future and it starts with the father. 

    “First thing, Jamie needs to go. He’s got to go,” she shared. “We just heard a great statement from [Jamie] and we were talking about it. Where is the last sentence where he says, ‘Clearly by being here, I’m harming my daughter more than doing her good. I will resign because I know there are professionals who are co-conservators with me who can take over and do this seamlessly. I’m no longer needed.’ That’s a father. If you miss your daughter and you want that father-daughter relationship, your work is done.” 

    During this week’s hearing, the judge praised Britney for her courage in speaking out, but said the Grammy nominee needs to submit a petition to the court requesting the termination of the conservatorship before any next steps could be taken. No new dates were set.

    “I think [Britney] really needs to focus on showing the court that she’s capable of taking care of herself and taking care of her basic needs,” Tamar explained. “She needs to follow up on her appointments, perhaps if she doesn’t want to work, she doesn’t have to work, but she can do some charity work.”

    As for Jamie, Tamar believes he has some explaining to do if he wants to stay on as co-conservator. As she noted, “He needs to show up and express why…we’re not in 2008 anymore. In 2008, he stepped up and he was the only one that stepped up when she was in dire straits. Everybody knows that. He did great. He did his job. Right now, staying on this conservatorship is doing her more harm than good and he needs to explain why he needs to stay.”

    She partially attributed this to her mother, Lynne Spears, describing how “one of my mother’s best traits” was her ability to stay strong in the face of adversity. “No matter how s–tty a day was when I was younger … for the sake of me and my siblings she always pretended like everything was ok,” Britney explained.

    However, the 39-year-old singer now wants the public to understand her experience, saying, “I’m bringing this to peoples attention because I don’t want people to think my life is perfect because IT’S DEFINITELY NOT AT ALL … and if you have read anything about me in the news this week … you obviously really know now it’s not !!!!”

    Meanwhile, a separate source close to Sam shed some light on his role in Britney speaking out. The insider explained how the actor has been a wealth of support to Britney, saying, “She feels empowered beyond words, and a large part of that is Sam, who empowers her in every way and has been her rock throughout this entire ordeal since she decided to speak up. She is eternally thankful to have him in her corner.”

    And a third source confirmed Sam is with Britney for the long haul. “Marriage is definitely something they have talked about and Sam would marry Britney immediately, if they were allowed,” the insider said. “They are truly in love and Sam will always be there for her. They do have plans for the future but the first step is getting Britney out of the conservatorship.”
